Terms of a Construction Contract Construction Contract What component parts are required for the formation of a contract? There are four components which are essential for the formation of a contract. They are: Offer, Acceptance, Consideration and Intention to create legal relationship What do we mean by terms of a contract? The terms of a contract are the statements that describe the rights and obligations of each party to the agreement. Terms are all the matters agreed between the parties about what is to be done, how it will be done and under what circumstances. Exactly what those terms are must be determined by the parties to the agreement. Terms are the elements of the contract. They are binding and carry legal consequences if they are broken. They can be divided into two categories: Implied Terms Expressed Terms. An express term is stated by the parties during negotiation or written in a contractual document. Implied terms are not stated but nevertheless form a provision of the contract. Do all terms carry equal weight in law? If not what are the differing categories, and why is it important to categorise contract terms? No, not all terms carry equal weight in law. Lawyers divide contractual terms into warranties and conditions. There might be a third type, the inominate term (term without a name) Conditions are terms that go to the very root of a contract. Breach of these terms gives the right torepudiatethe contract, allowing the other party to discharge the contract. A warrantyis less imperative than a condition, so the contract will survive a breach. Breach of either a condition or a warranty will give rise todamages. Lord Diplock, inHong Kong Fir Shipping Co Ltd v Kawasaki Kisen Kaisha Ltd, created the concept of an innominate term, breach of which may or may not go to the root of the contract depending upon the nature of the breach. Breach of these terms, as with all terms, will give rise to damages. Whether or not it repudiates the contract depends upon whether legal benefit of the contract has been removed from the innocent party. When are terms implied and what are the rules governing the inclusion of such terms? An express term is stated by the parties during negotiation or written in a contractual document. The purpose of implied terms is often to supplement a contractual agreement in the interest of making the deal effective for the purpose of business, to achieve fairness between the parties or to relieve hardship. Terms may be implied into contract through statutes or by the courts. When implied by statute, Parliament may well make certain terms compulsory, example: Sales of Goods Act 1979 When terms are implied by courts, the general rule is that they can be excluded by express provision in any agreement. The courts have developed an apparent distinction between terms implied in fact and those implied in law. Terms implied in fact are said to arise when they are strictly necessary to give effect to the reasonable expectations of the parties. Terms implied in law are confined to particular categories of contract, particularly employment contracts or contracts between landlords and tenants, as necessary incidents of the relationship. What is meant when reference is made to a standard form of contractâ⬠? Standard Form Contracts are agreements that employ standardized, non-negotiated provisions, usually in preprinted forms. These are sometimes referred to as ââ¬Å"boilerplate contracts,â⬠contracts of adhesion, or take it or leave it contracts. The terms, often portrayed in fine print, are drafted by or on behalf of one party to the transaction ââ¬â the party with superior bargaining power who routinely engages in such transactions. With few exceptions, the terms are not negotiable by the consumer. Examples of standard form contracts are insurance policies (where the insurer decides what it will and will not insure) Is there an alternative to a ââ¬Å"standard form of contractâ⬠? There is an alternative to a standard form of contract, usually standard form of contracts can be modified, terms/clauses added/amended to suit a specific projects. Another form of contract is : Bespoke Contract How many ââ¬Å"standard form contractsâ⬠do you know about? Is there one type of standard form ââ¬â or is there more than one? There is more than one type of form of contract, namely: Joint Contractors Tribunal (JCT) New Engineering Contract (NEC) La Federation Internationale Dââ¬â¢Ingenieurs-Conseils (FIDIC) Association of Consultant Architects (ACA Form of Contract; PPC 2000) Chartered Institute of Building (CIOB) GC/Works/1 Contract for building and civil engineering major works ICE 7 Conditions of Contract Measurement Version Who publishes ââ¬Å"standard form contractsâ⬠and how do you get one? Professional Registered Bodies (ACA, ACE, BPF, CIC, FIDIC, GC/Works, ICE, ICC, IChemE, IMechE, JCT, NEC (NEC3), PPC (PPC2000), RIBA, and RICS) publishes the standard form of contracts and they are subject to copyrights. You can buy hard copy and digital copies of the various standard forms from a number of external websites and specialist bookshops: ACA PPC2000. The PPC2000 may be bought from theACAs website. ACA Standard Form of Agreement for the Appointment of an Architect. The SFA may be bought from theACAs website. The 2012 version includes Construction Act 1996 amendments. ACE Agreements 2009. The ACE Agreements 2009 may be bought from theACEs website. BPF Consultancy Agreement Version 2. The BPFs Consultancy Agreement Version 2 is available to buy from the construction contracts section of theBPF website. Building Centre bookshop. The Building Centre bookshop stocks a variety of materials for the built environment, including a number of the standard form contracts published by the ACE, FIDIC, JCT, NEC and RICS. TheChartered Institute of Buildings(CIOB) online bookshop sells its own forms of contract, such as the CIOB Facilities Management Contract and CPC 2103, as well as other forms of contract. The second edition (November 2011) includes amendments prepared by the CIC to take account of the changes to the Construction Act 1996. FIDIC forms of contract. Theodore Levittââ¬â¢s contribution to marketing is undoubtedly un-measurable in any quantity, un-describable in a matter of words and unfathomable to any one who did not have the chance to meet the legendary scholar. The German moved to America after serving in the Second World War, where he received a PhD from the Ohio State University in economics. He later acted as a Professor in Harvard Business School and went on to become an editor for the ââ¬Å"Harvard Business Reviewâ⬠(1985-1989). Through the captivating articles he wrote for this, he changed the face and idea of marketing completely. What could have once been summed up in four Ps; price, product, place and promotion, now had depth, dimensions and true meaning. In a few short pages Levitt had the ability to expand, alter and moderinise marketing. The economist managed all this through his compelling article ââ¬Å"Marketing Myopiaâ⬠in which he describes how too much attention is paid to the product and n ot enough to the consumer. This was a foreign outlook, which no longer looked at just the physical good and maximizing profits but at who was purchasing this product and attempting to entice them to repeat purchase. He saw globalisation as a future phenomenon and saw standardisation as key to global success for a business. Theodore Levitt also had a profound impact on the lives of his students, colleagues, family and friends. He influenced them to think in new ways and to push the boundaries on how they saw the world. The German-American professor contributed greatly to the world of marketing and looked at businesses, selling products and service and where and how to sell them, in a new light. Levittââ¬â¢s article ââ¬Å"Marketing Myopiaâ⬠(1960), which won the McKinsey Award in 1960 (h... ...with the improvements in technology. Everyone wants what everyone else has. The days of customisation and originality are long gone. His ability to influence new thinkers was he greatest attributes. He was both provocative and startling which made him so bold and brilliant. People were intimidated by his presence and wanted to keep up with him. His trail of thought never stopped and he unconditionally allowed this brilliance to be shared with all of those whom he came into contact with. His writings and words touched the lives of various people and allowed them to explore new areas. Theodore Levittââ¬â¢s contribution to the marketing world knows no bounds nor will it ever. His simplistic, long-term, future focused ideas changed the world of business and served as a spin-off effect for other scholars allowing his work to assist in the future of marketing.

Cause and Effects of Stress in Children Essay
Stress is a response to a factor or situation that negatively affects the physical, emotional, or psychological existence of a person. Stress is good in small quantities as it motivates a person making him/her more productive. However, too much stress is detrimental to a person. Stress can interfere with the general life of a person. Most people assume that stress only affects adults. However, statistics indicate that stress also affects children. Children face intense pressure from their environment. Continuous stress in children is harmful to their activities, health, and development. There are a number of causes and effects of toxic stress in children. Stress can be caused by both negative and positive situations. Children living in abusive environments, both physical and emotional, experience stress. Arnold wrote that children who are bullied are in continuous state of depression. They, therefore, alienate themselves from their colleagues. Parents who constantly beat their children are also causes of stress. The fear that is manifested in children disorients them. They will not be able to talk about what they feel to anybody but rather keep to themselves. Events such as accidents, loss of loved ones, and rejection are also causes of stress in children. Social change patterns in children cause many stressful situations. Children at puberty yearn for freedom. This creates tension between them and the parents, who are constantly monitoring and regulating their activities. In the same stage, children will constantly be in need of money. Lack of money causes stress in children as they are not always able to buy whatever they may need. They will compare themselves with other children who are in comfortable financial positions. Such children are always anxious and worried of where and how they will get money. Stress in children is not only caused by what happens in their own lives but also by what happens in their parentsââ¬â¢ lives. The greatest effects of stress are experienced by the brain. The brain controls all the stress mechanism in the body making it the primary stress organ. Johnson stated that the vulnerability of childrenââ¬â¢s brain is causedà by the fact that they are constantly growing and developing. Constant stress in children disrupts brain development and compromises its normal function. Research has indicated that children experiencing stress have smaller brains. Toxic stress impairs the connection of brain circuits resulting in development of a smaller brain. Prolonged period of stress in children affects their nervous and immune system. Stress hormones are released when a child is exposed to stress. Cortisol hormones, which are released as a result of stress, suppress the body immune system. This leaves a person vulnerable to diseases and infections. Depression, alcoholism, eating disorders, and chronic diseases are also linked to childhood stress. Psychological effects of stress include changes in personality, aggressiveness, and irritability. Children under stress are likely to experience frustrations and isolation from friends and family. They spend more time on their own and lack motivation. Children may also have difficulty in concentration thereby affecting their academic performance. Children under extreme stress exhibit change in behavior. They may be more disobedient, fight often, stutter, and cry often. In conclusion, stress in children has many causes and effects. The notion that stress only affects adults is wrong. Too much stress, often referred to as toxic stress, is detrimental to the life of a child. Toxic stress affects the physical, emotional, psychological, and social aspects of a child. Even though every child reacts differently under stress, it is clear that stress affects the neural system and the health of a child. Children under stress tend to develop negative characteristics like irritability and disobedience. Research has indicated that there are number of causes of childhood stress which are interrelated. Social change patterns, abusive environment, and stress in parents are just some of the cause of childhood stress.

Gender Stereotyping: Can I Be What I Want to Be? Children before they are even born are put into two categories, male or female. If they are male they are automatically chosen to wear ââ¬Å"boyâ⬠colors such as blue, whereas a female is chosen to wear ââ¬Å"girlâ⬠colors such as pink. Boys should like cars, trucks, and planes, and girls should like sparkles, princesses and butterflies. Without even realizing it, parents gender stereotype their child. Boys are raised to be fathers and become doctors or lawyers. Girls are raised to be mothers and become either a house wife, nurse, or teacher. According to Gooden and Gooden (2001), books have been used as a socializing tool to transmit these values to the next generation. Gooden and Gooden also found that the traditional view of the male appeared to be accepted and valued, therefore a female representation was never challenged.
